VirtueTank LLC ("Datestiny," "we," "us," or "our") operates Datestiny (the "App"), a web-based dating service accessible through your browser at app.datestinyapp.com. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our App.

By using Datestiny, you agree to the collection and use of information in accordance with this policy. If you do not agree, please do not use the App.

2. Information We Collect

2.1 Information You Provide

  • Account Information: Phone number (used for authentication via SMS verification), email address, first name, date of birth, and gender.
  • Profile Information: Photos, height, ethnicity, interests, lifestyle preferences (drinking, smoking, exercise, diet), religious and political views, education, job title, languages spoken, and pet ownership.
  • Matching Preferences: Age range, distance, gender preferences, relationship goals, partner preferences (values, lifestyle, and "three Bs" — brains, brand, body).
  • Green Flags & Red Flags: Qualities you value and dealbreakers in potential partners.
  • Communications: Messages you send through the App, including conversations with your AI Coach and messages with other users.

2.2 Information Collected Automatically

  • Device Information: Device type, operating system, unique device identifiers, and push notification tokens.
  • Usage Data: App interactions, feature usage, and crash reports (via Firebase Crashlytics).
  • Analytics Data: Anonymous usage analytics (via Firebase Analytics) to improve the App experience.

2.3 Information from Third Parties

  • Authentication Providers: If you link your Google or Apple account, we receive your name and email from those services.
  • Subscription Status: Our subscription provider (RevenueCat) tells us whether your Datestiny Pro subscription is active, when it was purchased, and when it renews. We do not receive your payment-card details — those are handled exclusively by Apple. Apple may share aggregated, anonymized purchase metrics with us.

3. How We Use Your Information

  • Matchmaking: Our AI-powered system analyzes your profile, preferences, and interaction patterns to suggest compatible matches.
  • AI Coach: Your profile data and conversation history are used by our AI Coach (powered by Google Gemini) to provide personalized matchmaking guidance.
  • Communication: To facilitate messaging between matched users.
  • Safety: Our AI Safety Agent evaluates matches and conversations for potential safety concerns.
  • Notifications: To send push notifications about new matches, messages, and app updates.
  • Improvement: To analyze usage patterns and improve our matching algorithms and user experience.
  • Support: To respond to your requests and provide customer service.

4. AI and Automated Processing

Datestiny uses artificial intelligence extensively in its matchmaking process:

  • A multi-agent AI system evaluates compatibility across dimensions including values alignment, conversation potential, and safety.
  • Your AI Coach uses your profile and conversation context to personalize match recommendations.
  • We do not perform face or photo verification, and we do not collect, store, process, or transmit biometric data of any kind. Profile photos are not checked against a live selfie or any identity document. If we introduce photo verification in future, we will update this policy before it takes effect.

5. Data Sharing and Disclosure

We do not sell your personal information. We may share your information in these limited circumstances:

  • Other Users: Your profile information (name, age, photos, interests, and non-private fields) is visible to other users as part of the matching process. Only your age and location are privacy-gated; all other profile fields are always visible.
  • Service Providers: We use Firebase (Google Cloud) for authentication, database, storage, and cloud functions. Google Gemini processes AI matchmaking interactions. RevenueCat manages subscription entitlements; Apple handles all payment processing for in-app purchases. Beehiiv stores and delivers our email newsletter — if you sign up via our website, your email address is shared with Beehiiv for that purpose only.
  • Safety and Legal: We may disclose information if required by law, to protect safety, or to enforce our Terms of Service. See Section 6 for the specific protocols we follow for law enforcement requests.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred.

6. Law Enforcement Cooperation and Legal Requests

VirtueTank LLC cooperates with law enforcement agencies investigating unlawful activity involving our platform — including human trafficking, sexual exploitation, and crimes against children — in accordance with applicable law. This section describes the protocols we follow when we receive law enforcement inquiries and requests for user data.

6.1 Submitting a Request

Law enforcement agencies may submit legal requests to info@datestinyapp.com with "Law Enforcement Request" in the subject line. Requests must be issued on agency letterhead and include: the requesting agency and officer's name, badge or identification number, an official government email address, the legal authority for the request, the specific account identifier(s) (email address, phone number, or user ID) and data categories sought, and the relevant timeframe. We review every request for legal sufficiency before responding and may ask for clarification or narrowing of overbroad requests.

6.2 Legal Process Required

Consistent with the U.S. Stored Communications Act (18 U.S.C. § 2701 et seq.), the type of data we can disclose depends on the legal process served:

  • Basic subscriber information (name, email address, phone number, account creation date, subscription status): a valid subpoena or equivalent legal process.
  • Non-content records (login timestamps, device identifiers, usage metadata): a court order under 18 U.S.C. § 2703(d) or equivalent.
  • Content of communications (messages, photos, profile content): a search warrant issued upon probable cause or equivalent legal process.

6.3 Emergency Disclosure

Where we have a good-faith belief that an emergency involving imminent danger of death or serious physical injury to any person requires disclosure without delay, we may voluntarily disclose information to law enforcement as permitted by 18 U.S.C. § 2702(b)(8) and § 2702(c)(4). Emergency requests should be marked "Emergency Disclosure Request" and describe the nature of the emergency and why it involves imminent harm.

6.4 Preservation Requests

Upon receipt of a preservation request under 18 U.S.C. § 2703(f), we will preserve the requested records for 90 days, renewable once for an additional 90 days, pending issuance of legal process.

6.5 Mandatory Reporting

We report apparent child sexual abuse and exploitation material to the National Center for Missing & Exploited Children (NCMEC) as required by 18 U.S.C. § 2258A, and we preserve associated evidence. We may also proactively report suspected human trafficking, sexual exploitation, and other imminent-harm activity to the appropriate authorities.

6.6 User Notice

Our policy is to notify users of legal requests for their data before disclosure, unless we are legally prohibited from doing so (for example, by a non-disclosure order under 18 U.S.C. § 2705(b)) or where notice would risk harm to an identifiable individual, obstruct an investigation into serious harm, or involve an emergency as described above.

6.7 International Requests

Requests from law enforcement agencies outside the United States must be submitted through a mutual legal assistance treaty (MLAT), letters rogatory, or other established diplomatic or legal channels, unless applicable law (such as the CLOUD Act) provides an alternative lawful basis.

7. Data Storage and Security

Your data is stored on Firebase (Google Cloud Platform) infrastructure with industry-standard security measures including:

  • Encryption in transit (TLS) and at rest
  • Firebase Security Rules restricting data access to authorized users
  • Firebase App Check to prevent unauthorized API access
  • Server-side validation of all sensitive operations

While we implement safeguards, no system is 100% secure. We cannot guarantee absolute security of your data.

8. Data Retention

  • Active accounts: We retain your data for as long as your account is active.
  • Match candidates: Expired match candidates are automatically cleaned up after 48 hours.
  • Account deletion: When you delete your account, we delete your profile, photos, and associated data. Some data may persist in backups for up to 30 days.
  • Legal obligations: We may retain certain data as required by law.

9. Your Rights

Depending on your jurisdiction, you may have the right to:

  • Access: Request a copy of your personal data.
  • Correction: Update or correct inaccurate information via your profile settings.
  • Deletion: Delete your account and associated data through the App's Settings screen.
  • Data Portability: Request your data in a portable format.
  • Opt-out: Manage notification preferences in the App's settings.

10. Children's Privacy

Datestiny is not intended for anyone under the age of 18. We do not knowingly collect information from children. If we learn we have collected data from a child under 18, we will delete it promptly.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy in the App or via push notification. Your continued use of the App after changes constitutes acceptance of the updated policy.
