Terms of Service

1. Acceptance of Terms

By accessing or using Datestiny ("App"), a web-based service available at app.datestinyapp.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

VirtueTank LLC ("Datestiny," "we," "us," or "our") reserves the right to modify these Terms at any time. Continued use after changes constitutes acceptance.

2. Eligibility

  • You must be at least 18 years of age to use Datestiny.
  • You must be legally able to enter into a binding contract.
  • You must not be prohibited from using the App under applicable laws.
  • You may only maintain one account.

3. Account Registration

  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the security of your account credentials.
  • You must promptly update your information if it changes.
  • You are responsible for all activity that occurs under your account.

4. User Conduct

Your use of Datestiny is also governed by our Acceptable Use Policy, which details prohibited content and behavior. In summary, you agree not to:

  • Provide false or misleading information in your profile.
  • Use another person's photos or impersonate anyone.
  • Harass, threaten, abuse, or intimidate other users.
  • Send unsolicited commercial messages or spam.
  • Use the App for any illegal or unauthorized purpose.
  • Attempt to interfere with, compromise, or disrupt the App's systems.
  • Solicit money or other items of value from other users.
  • Post content that is hateful, discriminatory, violent, or sexually explicit.
  • Use automated systems, bots, or scripts to interact with the App.
  • Circumvent any safety, security, or content moderation measures.

5. Zero Tolerance: Human Trafficking and Sexual Exploitation

Datestiny maintains absolute zero tolerance for human trafficking and sexual exploitation in any form. The following are strictly prohibited and will result in immediate permanent account termination, preservation of evidence, and referral to law enforcement:

  • Human trafficking of any kind, including sex trafficking and labor trafficking — recruiting, harboring, transporting, providing, obtaining, advertising, or soliciting a person for the purpose of exploitation.
  • Sexual exploitation — coercing, deceiving, manipulating, or forcing any person into commercial sexual activity or non-consensual sexual conduct, or profiting from such activity.
  • Commercial sexual services — offering, soliciting, advertising, or facilitating prostitution, escort services, or any other form of commercial sexual activity.
  • Exploitation of minors — any content or conduct that sexualizes, exploits, or endangers anyone under 18. Such material is reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement.
  • Using the App to arrange, promote, facilitate, or profit from any of the above, whether the underlying activity occurs on or off the platform.

We cooperate fully with law enforcement in the investigation and prosecution of these offenses, following the protocols described in our Privacy Policy. Suspected violations can be reported from within the App or by emailing info@datestinyapp.com.

6. AI Coach and Matchmaking

  • Datestiny uses AI-powered matchmaking including an AI Coach that provides personalized recommendations.
  • AI recommendations are suggestions only and do not constitute professional advice of any kind.
  • We do not guarantee compatibility, relationship outcomes, or the accuracy of AI assessments.
  • Match candidates are generated daily and expire after 48 hours if not acted upon.
  • You are limited to one active conversation at a time to encourage meaningful connections.

7. Photos and Content

  • You retain ownership of content you upload but grant Datestiny a non-exclusive, worldwide license to use, display, and distribute your content within the App for matchmaking purposes.
  • All photos must contain a clearly visible face. We do not currently verify that profile photos depict the account holder, and photos should not be treated as identity-verified.
  • You represent that you have the right to upload all content you share.
  • We may remove content that violates these Terms without notice.

8. Safety

  • Datestiny includes an AI Safety Agent that evaluates interactions, but we cannot guarantee the behavior of other users.
  • You are solely responsible for your interactions with other users, including any in-person meetings.
  • We strongly recommend meeting in public places and informing someone you trust when meeting a match for the first time.
  • Use the block and report features if you encounter inappropriate behavior.

9. Subscriptions and Payments

  • Datestiny offers an auto-renewing subscription called Datestiny Pro, sold in weekly and annual plans.
  • On the web app, payment is processed by Stripe. The annual plan includes a 7-day free trial; your payment method is charged when the trial ends unless you cancel first. The weekly plan has no trial and is charged at purchase.
  • Subscriptions automatically renew at the end of each billing period until canceled. Cancel anytime from the App's Settings → Manage Subscription; cancellation takes effect at the end of the current billing period, and you retain Pro access until then.
  • Refunds are governed by our Refund Policy. Billing errors — duplicate subscriptions or duplicate charges — are always refunded in full.
  • If you subscribed through the iOS App Store version of the App, payment was processed by Apple under the App Store's terms, and Apple's refund process applies (reportaproblem.apple.com).
  • Prices are listed in the App and may vary by region or currency. We may change prices with prior notice for renewal periods; existing renewals continue at the original price until your next renewal cycle.
  • Subscription benefits are limited to the user account that purchased the subscription and may not be transferred.

10. Account Termination

  • You may delete your account at any time through the App's Settings screen.
  • Account deletion is permanent and removes your profile, photos, matches, and conversations.
  • We may suspend or terminate your account if you violate these Terms.
  • We reserve the right to remove accounts that appear inactive, fraudulent, or harmful.

11. Disclaimers

  • The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
  • We do not conduct criminal background checks on users.
  • We do not verify the accuracy of user-provided information, including profile photos. Photos are not checked against a live selfie or any identity document.
  • We are not responsible for the conduct of any user, whether online or offline.

12. Limitation of Liability

To the maximum extent permitted by law, VirtueTank LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages for loss of profits, data, or other intangibles, even if we have been advised of the possibility of such damages.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VirtueTank LLC is incorporated, without regard to conflict of law principles.
